GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

PREAMBLE / PRESENTATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (GTCS) define the contractual relationship between, on the one hand, any customer of the website www.abuzone-shop.fr, whether an individual or a professional, hereinafter referred to as "the customer" or "the buyer", and, on the other hand, Florian Sanna aka AbuzOne, publisher of the website www.abuzone-shop.fr, hereinafter also referred to as "the author" or "www.abuzone-shop.fr". These GTCS apply to sales of original fine art photographic prints, limited or open editions, and merchandise.

Florian Sanna, artist name: AbuzOne (referred to under the identity Florian Sanna aka AbuzOne), SIRET No.: 801 247 958 00011, operates as an Author-Photographer (Auteur-Photographe, NAF code: 90.03A), and is not subject to any specific professional rules. These GTCS are presented in the French language and are intended for a consumer who possesses full legal capacity.

GTCS AND BUYER'S CONDITIONS

These GTCS are the only ones applicable. They prevail over all other general and specific conditions not expressly approved by Florian Sanna aka AbuzOne, and notably replace those of the buyer.

AMENDMENT OF THE GTCS

Florian Sanna aka AbuzOne reserves the right to modify these GTCS at any time, without prior notice. The applicable GTCS are those in force on the date of the order by the buyer.

ACCEPTATION OF THE GTCS

Placing an order automatically implies the customer's full acceptance of these GTCS and the waiver of their own general and specific contractual conditions. The customer declares that they agree to these GTCS, having read them, without restriction or reservation, from the moment they place their order.

GTCS AND UNAUTHORIZED USE

These GTCS also apply to unauthorized uses of photos or texts appearing on the website www.abuzone-shop.fr, regardless of the manner in which the user obtained the photo or text.

ARTWORK PRICES AND V.A.T.

Florian Sanna aka AbuzOne, author-photographer, has opted for the tax exemption status (franchise en base de TVA). The prices indicated on www.abuzone-shop.fr are therefore net (VAT not applicable, Article 293B of the French General Tax Code / CGI), in Euros, and include packaging costs.

PRICE UPDATES

Florian Sanna aka AbuzOne reserves the right to modify his prices at any time. Prints are invoiced based on the rates in effect at the time the orders are registered, subject to availability.

ZONE & SHIPPING FEES

The prints offered can be shipped to the following destinations: Mainland France, French Overseas Territories (DOM-TOM), European Union countries, and Monaco. For delivery to other destinations, please contact me so that we can evaluate the feasibility of the shipment together. Shipments can be insured up to the value of the shipped prints. Shipping costs are borne by the buyer. They depend on the delivery method chosen and the destination. Prices indicated at the end of the order are net.

ORDER STAGES

For standard items sold directly on the website: The buyer places an order via the Shopify interface of www.abuzone-shop.fr, selecting the product of their choice (Open Edition, merchandise, collector envelopes), validating their shopping cart, filling in the information required for payment and delivery, and finally proceeding to checkout. The order becomes firm and final upon validation of the payment by the buyer.
For the "Exhibition Prints" range (Custom-made): These items cannot be ordered directly online. The buyer must formulate their request by email. A personalized exchange will define the specifications (size, medium, finishes). A quote or specific payment link will then be sent to the customer. Payment of this quote constitutes acceptance of the GTCS and initiates the custom production, making the order final and not subject to the right of withdrawal.

PAYMENT

The payment methods available on the website are: Paypal®, ShopPay, Credit/Debit Card (Secure online payment). Bank details are encrypted using the Secure Sockets Layer (SSL) protocol. No banking information is transmitted unencrypted over the networks. I never have access to your banking details.

VALIDATION & TRACKING

After validation and payment of the order, Florian Sanna aka AbuzOne sends an automatic confirmation email to the buyer. This email summarizes all details of the order, including shipping costs.

SHIPPING AND DELIVERIES

Ordered prints are sent to the delivery address specified during the order process. Depending on the size, packaging consists of a reinforced rigid cardboard mailer or a rigid cardboard tube. In-person pickup is possible in Montpellier (34000) and its surroundings (+/- 15km). Shipping for standardized products generally occurs within a maximum period of 3 weeks from payment. As the actual delivery time depends on the carrier, any delivery delay cannot give rise to compensation or damages payable by Florian Sanna aka AbuzOne.

CUSTOMS AND EXTRA-COMMUNITY TAXES

For all artworks shipped outside the European Union and French Overseas Territories (DOM-TOM), customs duties or other local taxes are the exclusive responsibility of the customer, who bears full responsibility both in terms of declarations and payments.

RECEIPT AND VERIFICATION OF THE ORDER

Upon receipt, carefully inspect the condition of the package. If the package is visibly damaged, refuse it without opening it and notify this in writing on the carrier's delivery note. Contact the author within 48 hours. In the event of damage discovered after unpacking, you have a legal period of 3 days (Article L 133-3 of the French Commercial Code) to notify your claims to the carrier via registered letter, and you must immediately contact Florian Sanna aka AbuzOne with supporting photos to establish an exchange or refund protocol.

HANDLING AND MAINTENANCE

To preserve your prints (sensitivity to light, humidity, fingerprints), the use of gloves is strongly recommended during handling. Photographic art prints are not designed to be displayed outdoors, nor in direct proximity to a significant heat source.

RIGHT OF WITHDRAWAL (STRICT COMPLIANCE WITH EU REGULATION)

In accordance with Articles L221-18 et seq. of the French Consumer Code (Code de la consommation):

Eligible Items (Online Shop): For standard products purchased directly on the website (Open Edition prints, collector envelopes, merch), the buyer has a period of 14 calendar days from receipt to exercise their right of withdrawal. The right of withdrawal can be exercised directly online in 2 clicks via the mandatory "Withdraw from the contract here" (Rétracter le contrat ici) button located in the website's footer, or by any other unambiguous statement. Return shipping costs are borne by the customer. The refund will be processed within 14 days after retrieving the products in their original condition and packaging.
Excluded Items (Custom Exhibition Prints): In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Exhibition prints ordered by email, manufactured on demand and according to custom criteria, are therefore strictly excluded from any right of withdrawal, exchange, or return with Florian Sanna aka AbuzOne.

LIABILITY

The choice and purchase of a product are under the sole responsibility of the customer. Minor differences in colors, brightness, or contrast may be observed depending on the screens used to view the images on the website; consequently, the website visuals are non-contractual. For professional purchases, the seller cannot be held liable for loss of business or loss of profits.

LIMITATIONS RELATED TO THE OWNERSHIP OF A PRINT

The purchase of a photograph in the form of a print or reproduction does not entail the assignment of the rights of public performance or reproduction. Only private and family use is authorized (Article L. 111-3 of the French Intellectual Property Code / CPI).

OBLIGATION TO PRESERVE PRINTS

In accordance with the law (Article L121-1 of the French Intellectual Property Code), the holder of a signed work of art is required to ensure good conditions of preservation and must under no circumstances intentionally destroy it.

FORCE MAJEURE & INCAPACITY

Florian Sanna aka AbuzOne cannot be held responsible if any delay or non-performance results from a case of force majeure (transport strikes, loss of the package by the carrier, natural disasters). In the event of incapacity for work due to illness or accident, Florian Sanna aka AbuzOne reserves the right to modify the delivery timeframe or to terminate the contract by refunding the customer, without further compensation.

APPLICABLE LAW - DISPUTES

These GTCS are subject to French law. In the event of a dispute, and failing an amicable agreement, exclusive legal jurisdiction is assigned to the competent French court closest to the author's place of residence.
